Regulation on existing discharge systems

A person who immediately before the commencement of this Act, was discharging any sewage or trade effluent into a stream, well, sewer or on land, requires the consent of the state board for continuing such activity.

In order to obtain the consent of the state board for such activity, an application in the prescribed form must be sent to the state board. The state board is empowered to make certain inquiries that it may consider necessary before it grants consent or rejects an application. If the state board grants consent, it may impose certain conditions that must be adhered to.

Carrying out a prohibited activity or a regulated activity in contravention of the provisions of the act amounts to an offence under the Act. To read about offences under the Act, and the penalties for such offences, go to ‘Offences and Penalties’
