Restriction of the application of the Act to certain areas in a state

 

If the state government is of opinion that the provisions of this Act need not apply to the entire state, it may, by notification in the official gazette, restrict the application of this Act to certain areas only. Such a decision is made after consultation with, or on the recommendation of, the state board. The area(s) to which the Act is restricted are declared as ‘Water pollution, prevention and control area(s)’. After such a notification is issued, the provisions of the Act apply only to these areas.

Each ‘Water pollution, prevention and control area’ may be declared by reference to:

Or partly by one method and partly by another

The state government may, by notification in the official gazette:

(a) Alter any ‘water pollution prevention and control area’ whether by way of extension or reduction, or
(b) Define a new ‘water pollution, prevention and control area’ in which one or more such areas (or parts of such areas) may be merged.
