State Water Laboratories and Analysts
State Water Laboratory
The state government may, by notification in the official gazette:
- Establish a State Water Laboratory, or
- Specify any state laboratory or institute as a State Water Laboratory, to carry out the functions entrusted to the State Water Laboratory under this Act.
Section 52.1
The state government may, after consultation with the state board, make rules prescribing:
- The functions of the State Water Laboratory
- The procedure for the submission to the said laboratory of samples of water or of sewage or trade effluent for analysis or rests, the form of the laboratory's report thereon and the fees payable in respect of such report
- Such other matters as may be necessary or expedient to enable that laboratory to carry out its functions.
Section 52.2
State Government Analyst
The state government may appoint such persons as it thinks fit, having the prescribed qualifications to be government analysts for the purpose of analysis of samples of water or of sewage or trade effluent sent for analysis to the State Water Laboratory or any other laboratory so recognized by the state government (see above).
Section 53.2
The functions of the state government recognized or established laboratories and government analysts relate to the analysis of samples collected by authorized persons under the Act. Upon following the due procedure for collection and analysis of such samples, the report of analysis produced by the appointed government analyst may be used as evidence in a court of law.
State Board recognized/established laboratories and appointed Board analysts also perform similar functions under the Act.
