Industry, operations & processes

There are certain responsibilities and requirements of industries, operations and processes that are specified by the Environment (Protection) Act, 1986. These would apply to persons carrying on industry operation or processes.
Following standards
No person carrying on any industry, operation or process is permitted to discharge or emit or permit to be discharged or emitted any environmental pollutant in excess of the standards prescribed.
Section 7
If there are industries, operation or process for which standards are not specified in Schedule I, these shall follow the standards specified in Schedule IV on and from the 1st January 1994.
Rule 3.3Ai of EP Rules
Comply with ambient air standards
Industries, operations, process, automobiles and domestic sources produce a combined effect of emission or discharge of environmental pollutants in an area. This is not permitted to exceed the relevant concentration in ambient air as specified against each pollutant in columns (3) to (5) of Schedule VII.

Furnishing information in the case of excess Environmental pollutant discharge
Prevent / Mitigate environmental pollution
In case the discharge of any environmental pollutant occurs in excess of the prescribed standards or is apprehended to occur, due to any accident or other unforeseen act or event, the person responsible for such discharge and the person in charge of the place shall be bound to prevent or mitigate the environmental pollution caused as a result of the discharge.

Intimate authorities and render assistance
They are also bound to intimate the concerned authorities or agencies regarding the fact of such occurrence or apprehension of such occurrence, as well as to render all assistance if called upon by the authorities or agencies as may be prescribed.

Expenses of remedial measures
Any expenses incurred by any authority or agency with respect to the remedial measures referred to in Section 9.2 on the discharge of excess environmental pollutant, together with interest (as fixed by the Government) may be recovered by such authority or agency from the person concerned as arrears of land revenue or of public demand. The interest charged will be computed from the date when a demand for the expenses is made until it is paid.
