DEFINITIONS

 

Certain words / phrases have been defined in the Act within the context in which they are used. These definitions have been listed in Section 2 of the Act. Below, we have provided a list of these definitions, and have also included definitions of words / phrases that have not been defined in the Act but have been added to aid in the understanding of legal text.

Throughout the text on this site, words that are found on the definitions list appear underlined; by clicking on such a word, the definition appears just below the word, so you do not have to repeatedly consult this list while reading other sections of the law.

Environment: "environment" includes water, air and land and the inter-relationship which exists among and between water, air and land, and human beings, other living creatures, plants, micro-organism and property

Environmental Pollutant: "environmental pollutant" means any solid, liquid or gaseous substance present in such concentration as may be, or tend to be, injurious to environment

Environmental pollution: "environmental pollution" means the presence in the environment of any environmental pollutant

Handling: "handling", in relation to any substance, means the manufacture, processing, treatment, package, storage, transportation, use, collection, destruction, conversion, offering for sale, transfer or the like of such substance

Hazardous substance: "hazardous substance" means any substance or preparation which, by reason of its chemical or physico-chemical properties or handling, is liable to cause harm to human beings, other living creatures, plants, micro-organism, property or the environment

Occupier: "occupier", in relation to any factory or premises, means a person who has control over the affairs of the factory or the premises and includes in relation to any substance, the person in possession of the substance

Prescribed: "prescribed" means prescribed by rules made under this Act.

Definition of terms in the Environment (Protection) Rules, 1986

In these rules, unless the context otherwise requires:

"Act" means the Environment (Protection) Act, 1986 (29 of 1986)

"Areas" means all areas where the hazardous substances are handled

"Central Board" means the Central Pollution Control Board constituted under section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);

"Form" means a form set forth in Appendix A to these rules;

"Government Analyst" means a person appointed or recognized as such under section 13

"Person" in relation to any factory or premises means a person or occupier or his agent who has control over the affairs of the factory or premises and includes in relation to any substance, the person in possession of the substance.

"Prohibited substance" means the substance prohibited for handling

"Recipient system" means the part of the environment such as soil, water, air or other which receives the pollutants;

Restricted substance" means the substance restricted for handling

Section" means a section of the Act

"Schedule" means a Schedule appended to these rules

"Standards' means standards prescribed under these rules

"State Board" means a State Pollution Control Board constituted under section 4 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) or a State Pollution Control Board constituted under section 5 of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981)
